Article 1. Scope Of Application
1. These Terms & Conditions and the “Hotel Room Rules of Use” are integral to matters concerning the Hotel Room Rental Agreement and related agreements that the Hotel concludes with its guests. Matters not stipulated in these Terms & Conditions are governed by laws and regulations or established common practice.
2. In cases where the Hotel has, within the scope consistent with laws, regulations, and common practice agreed to special provisions, such special provisions prevail irrespective of the stipulations of the previous paragraph.
Article 2. Application To Enter Into A Hotel Room Rental Agreement
1. The Guest seeking to enter into a Hotel Room Rental Agreement with the Hotel must provide the Hotel with the following information.
(1) Name of the guest(s)
(2) Room rental date/s and expected time of arrival
(3) Other information required by the Hotel ex) contact address, or etc.
2. If a guest makes an application during the hotel room rental period for the continuation of the room rental period beyond the room rental date/s pursuant to Item
(2) of the previous Paragraph, the application will be treated by the Hotel as a new
Hotel Room Rental Agreement made at that time.
Article 3. Conclusion Of Hotel Room Rental Agreement
1. An Hotel Room Rental Agreement is deemed finalized when the Hotel has approved an application pursuant to the previous Article.
2. When a Hotel Room Rental Agreement has been deemed finalized in accordance with the previous Paragraph, the hotel room charge for the entire hotel room rental period (3 days when the period of stay exceeds 3 days) comes due for payment, either before the commencement of the room rental period or on a date to be specified by the Hotel.
3. The deposit shall be first used for the Total Accommodation Charges to be paid by the Guest, then secondary for the cancellation charge under Article 6 and thirdly for the reparation under Article 18 as applicable, and the remainder, if any, shall be refunded at time of the payment of the Accommodation Charge as stated in Article 12.
4. When the Guest has failed to pay the deposit by the date as stipulated in Paragraph 2 of the Article 3, the Hotel shall treat the Hotel Room Rental Agreement as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the period of payment of the deposit is specified.
Article 4. Special Contracts Requiring No Accommodation Deposit
Notwithstanding the provisions of the Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit to finalize the Contract as stipulated in the same Paragraph.
1. In case when the Hotel has not requested the payment of the deposit as stipulated in Paragraph 2 of the preceding Article.
2. And/or when Hotel has not specified the date of the payment of the deposit at the time the application for an Accommodation Contract has been accepted.
Article 5. Refusal of Agreement
In any of the following cases, the Hotel reserves the right not to enter into a Hotel Room Rental Agreement.
(1) If a hotel room rental application is in non-conformity with these Terms & Conditions.
(2) If all hotel rooms are occupied and none are available.
(3) If the Guest seeking to rent a hotel room is, in the best judgement of the Hotel, reasonably likely in connection with use of the hotel room to act in violation of the stipulations of laws and regulations, public order, or good morals.
(4) If an applicant for a hotel room rental agreement or a party seeking to use a rented hotel room is a member, or related to a member, of a criminal organization, a body related to a criminal organization, or other organized crime group stipulated in the Act on the Prevention of Unlawful Acts by Crime Syndicate Operatives and the prefectural ordinances concerning the elimination of crime syndicates.
(5) When the Hotel is requested to assume an unreasonable burden in regard to the accommodation.
(6) If the Guest seeking to rent a hotel room has been clearly identified as a contagious disease carrier.
(7) When the Guest seeking accommodation acts violently, makes treats, intimidates, makes violent demands, or makes any other coercive or unreasonable demand or action.
(8) If a hotel room cannot be provided due to natural disaster, facility breakdown, or other compelling reason or circumstance.
(9) If Guest seeking to rent a hotel room is intoxicated and disorderly and as a result causes annoyance to other guests or is, in the best judgement of the Hotel, likely to interfere with the operations of the Hotel or engage in speech or actions that may cause annoyance to other guests or personnel of the Hotel.
And in other cases, that contravene stipulations of prefectural ordinances and other provisions.
Article 6. Right Of The Guest To Terminate Agreement
1. A guest has the right to terminate the hotel room rental agreement by giving notice to the Hotel.
2. In the case when the Guest has cancelled the Hotel Room Rental Agreement in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested the payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has cancelled before the payment), the Guest shall pay cancellation charges as listed in the Attached Table No.1. However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed of the obligation of the payment of the cancellation charges in case of cancellation by the Guest.
3. In the case when the Guest does not appear by 22:00 of the accommodation date (or 2 hours after expected time of arrival if the Hotel is notified of such) without an advance notice, the Hotel may regard the Hotel Room Rental Agreement as being cancelled by the Guest.
Article 7. Right Of The Hotel To Terminate Agreement
1. In any of the following cases, the hotel reserves the right to terminate the hotel room rental agreement.
(1) If the Guest seeking to rent a hotel room is, in the best judgement of the Hotel, reasonably likely in connection with use of the hotel room to act in violation of the stipulations of laws and regulations, public order, or good morals.
(2) If an applicant for a hotel room rental agreement or a party seeking to use a rented hotel room is a member, or related to a member, of a criminal organization, a body related to a criminal organization, or other organized crime group stipulated in the Act on the Prevention of Unlawful Acts by Crime Syndicate Operatives and the prefectural ordinances concerning the elimination of crime syndicates.
(3) When the Hotel is requested to assume an unreasonable burden in regard to the accommodation.
(4) If the Guest seeking to rent a hotel room has been clearly identified as a contagious disease carrier.
(5) When the Guest seeking accommodation acts violently, makes treats, intimidates, makes violent demands, or makes any other coercive or unreasonable demand or action.
(6) If a hotel room cannot be provided due to natural disaster, facility breakdown, or some other compelling reason.
(7) If Guest seeking to rent a hotel room is intoxicated and disorderly and as a result causes annoyance to other guests or, in the best judgement of the Hotel, is likely to interfere with the operations of the Hotel or engage in speech or actions that may cause annoyance to other guests or personnel of the Hotel.
And in other cases, that contravene the stipulations of prefectural ordinances and other provisions.
(8) When the Guest does not abstain from prohibited action such as smoking in the building, tampering with the fire-fighting facilities and other prohibitions of the Use Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to avoid the causing of fires, detection of fires, or automatic and manual suppression of fires).
2. In the case when the Hotel has cancelled the Hotel Room Rental
(not be entitled to charge the Guest for any services which the Guest did not receive during the contractual period.
Article 8. Registration Of Hotel Guests
Hotel guests are required to register on the room rental date the following information at the Hotel reception.
(1) Name, age, sex, address, and occupation of the guest.
(2) In the case of foreign guests, nationality, passport number, port of entry, and date of entry.
(3) Departure date and prospective departure time.
(4) Other information required by the Hotel ex) billing address
2. In the case when the Guest intends to pay the guest’s accommodation Charge prescribed in Article 11 by any means other than Japanese currency, coupons or credit cards, these credentials shall be shown in advance at the time of the registration prescribed in the preceding Paragraph.
Article 9. Hours of Hotel Room Use
1.Guests are permitted to use hotel rooms of the Hotel from the check-in time until the check-out time, respectively, set by the Hotel.
2.In the case when guests stay for 2 or more consecutive nights, hotel rooms are permitted to be used around the clock except for the days of arrival and departure.
3.The Hotel may, not with standing the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the room beyond the time prescribed in the same Paragraph. In this case, extra charges shall be paid. The extra charge is \1,000 per hour and the latest check out time is 12:00.
Article 10. Observance Of The Hotel Room Rules Of Use
Guests on the premises of the Hotel must observe the Hotel Room Rules of Use.
Article 11. Payment of charges
1. The breakdown of the hotel room charges, etc., payable by guest is stated in Table No. 2
2. Hotel room charges, etc., pursuant to the previous Paragraph are payable at guests' arrival or when requested by the Hotel, in Japanese currency, either by traveler checks accepted by the Hotel, or by hotel voucher, debit card, credit card, or other means of settlement accepted by the Hotel, at the reception.
3. Accommodation Charge shall be paid even if the Guests voluntarily do not utilize the accommodation facilities provide for him by the Hotel and which are at the Guest disposal.
Article 12. Liabilities Of The Hotel
1. The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest in the fulfillment or the nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in cases when such damage has been caused due to reasons for which the Hotel is not liable.
2.The Hotel carries Insurance coverage for unexpected fire and/or other disasters.
Article 13. Handling Of Cases When A Hotel Room Cannot Be Provided
1. If the Hotel is unable to provide a Guest with a hotel room as agreed, the Hotel Room Rental Agreement becomes null and void.
Provided, however, that to the extent possible the Hotel will by way of intermediation arrange for a different hotel facility on identical terms.
2. The provisions of the previous Paragraph notwithstanding, if the Hotel is unable by way of intermediation to arrange for a different hotel facility, the Hotel will pay a compensation amount to the Guest. Provided, however, that no compensation will be paid if the inability to provide a hotel room is not attributable to the responsibility of the Hotel.
Article 14. Liability Of Guests
Guests who cause damages to the Hotel due to willful misconduct or gross negligence are liable to compensate the Hotel for such damages.
Article 15. Handling Of Deposited Articles, etc.
1. The Hotel will provide compensation for the loss or damage, except if due to force majeure, of objects, valuables, or cash deposited by Guests at the reception of the Hotel.
Provided, however, that for articles whose kind and value was not from the inception clearly stated by the affected Guest, the compensation amount is limited to a maximum of ¥150,000- except in case of willful misconduct or gross negligence of the Hotel.
2. If due to reasons attributable to the responsibility of the Hotel, the Hotel will provide compensation for the loss or damage of articles, valuables, or cash brought by Guests onto the premises of the Hotel that were not deposited at the Hotel's reception.
Provided, however, that for articles whose kind and value was not from the inception clearly stated by the affected Guest, the compensation amount is limited to a maximum of ¥50,000.-- except in case of willful misconduct or gross negligence of the Hotel.
Article 16. Storage Of Guest’s Hand Luggage And Personal Effects
1. The Hotel will provide storage for Guest’s luggage arriving in advance only if the Hotel was contacted beforehand and has agreed to provide such storage.
2. If Guests leave hand luggage or personal belongings behind at the Hotel after checkout, as a rule, such items will be held in storage at the Hotel for a period of seven days after an item is found. Except, however, that valuables will be taken to the nearest police station seven days later. Furthermore, food, beverages, and magazines not claimed by the day after check-out will be disposed of at the discretion of the Hotel.
3. The Hotel’s liability in regard to the custody of Guest baggage and belongings in the case of the preceding two paragraphs shall be assumed in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article 15 in the case of Paragraph 2.
Article 17. Business Hours
The business hours of the facilities, etc. of the Hotel are as follows and those of other facilities, etc. shall be specified in detail by brochures as provided, notice displayed in each place, service directories in guest rooms and in other ways deemed suitable by the Hotel:
(1)Service hours of Front Desk, cashier’s desk, etc.

Attached Table No.1 Cancellation Charges
Remarks to Table No.1:
1.The percentages signify the rate of cancellation charge to the Basic Accommodation Charge.
2.When the number of days contracted is shortened, the cancellation charge for the total number of days shorten shall be paid by the Guest regardless of the number of days shortened.
